Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Zigdale’s website and AI sales services. By using our services or checking the box to accept these Terms at checkout, you agree to these Terms.

Use of Services

You agree to use Zigdale’s services only for lawful purposes and in compliance with applicable telecommunications, privacy, and data protection laws (including, where applicable, the Telephone Consumer Protection Act (TCPA), state analogues, and telemarketing rules). You will not use Zigdale to place harassing, fraudulent, or unsolicited communications in violation of law.

Accounts

You are responsible for maintaining the confidentiality of your account and for all activities that occur under it, including activity by users you invite.

Outbound calling, AI agent, and recordings

Zigdale provides software and an AI sales agent (“Morgan”) that can place outbound telephone calls to phone numbers associated with leads or contacts you provide or upload.

By using the outbound calling features (including activating calling / going live), you represent and agree that:

1. Authorization. You authorize Zigdale and Morgan to place outbound voice calls to the numbers you supply for your sales or outreach purposes, and you have the right to contact those persons.
2. Your compliance. You are solely responsible for compliance with TCPA, Do-Not-Call rules, consent requirements, industry-specific rules, and any internal policies applicable to your outreach. Zigdale does not obtain consent from your prospects on your behalf merely by you uploading a lead list.
3. AI disclosure. Calls may identify that the caller is an AI agent and/or that the call is recorded, according to product settings and applicable law. Owners may configure certain disclosure lines as described in-product; where you suppress a disclosure that would otherwise be spoken, you accept responsibility for that choice as presented in the product at the time of the action.
4. Recording. You authorize Zigdale to record and process call audio and transcripts to operate the service. You are responsible for providing any recording notices required in the jurisdictions where you call.
5. No guarantee of legality of a given call. Zigdale’s tools and default scripts do not guarantee that any particular call is lawful for your use case; you must configure and use the product appropriately.

Meeting Guarantee

Zigdale offers a free-month guarantee for the Zigdale LAUNCH subscription from signup onward.

If, during a billing period, Zigdale does not produce at least one high-engagement lead on your account, your next month’s subscription fee is waived (applied as a credit so the renewal invoice nets to zero). If that free period also produces no high-engagement lead, the following month is waived again. This continues until a high-engagement lead is obtained.

Once a high-engagement lead has been obtained on your account, the guarantee ends. Billing resumes at the regular LAUNCH rate from then on, including for later periods that produce no high-engagement lead. The guarantee does not restart.

A high-engagement lead is a non-deleted lead on your account that reaches engagement tier “high” in the product: Claude-assessed interest level of 4 or higher and at least two successful contacts (answered conversations). First-call interest alone does not satisfy the guarantee. Soft-deleted leads do not count when engagement is recorded; once high engagement is recorded for the account, a later downgrade of that lead does not revive the guarantee.

The guarantee applies only to the LAUNCH plan while the Stripe subscription is active or trialing. It does not apply to canceled, unpaid, or past-due subscriptions, and it does not create a cash refund of prior paid periods.

This clause supersedes any earlier “Calling Commencement,” “qualified meeting held,” “first 30 days / second month free,” or “every renewal forever” meeting-guarantee language.

Limitation of Liability

To the fullest extent permitted by law, Zigdale shall not be liable for indirect or consequential damages arising from your use of the services.
